TERMS OF USE

1. Introduction
Welcome to SreeViewer, a remote desktop and secure access software developed and operated by SreeViewer Private Limited (“Company”, “we”, “our”, or “us”).
By downloading, installing, or using SreeViewer (“Software”), you agree to be bound by these Terms of Use.
2. License Grant
We grant you a limited, non-exclusive, non-transferable license to use SreeViewer for personal or commercial purposes, subject to:
- Valid subscription or license purchase
- Compliance with applicable laws
- Adherence to these terms
3. Permitted Use
You agree to use SreeViewer only for lawful purposes, including:
- Remote technical support
- Business operations
- Personal device access
4. Prohibited Activities
You must NOT:
- Use SreeViewer for unauthorized access, hacking, or surveillance
- Reverse engineer, decompile, or modify the software
- Use the software to transmit malware or harmful content
- Violate data protection or privacy laws
5. User Responsibilities
- You are responsible for maintaining secure access credentials
- You must obtain explicit consent before accessing another device
- You are responsible for all activities performed using your account
6. Subscription & Payment
- SreeViewer may be offered via subscription or perpetual license
- Fees are non-refundable unless otherwise stated
- Failure to pay may result in suspension or termination
7. Intellectual Property
All rights, including software, branding, and technology, remain the property of:

You may not copy, distribute, or resell without written permission.
8. Data & Security
We implement industry-standard security measures. However:
- We do not guarantee uninterrupted or error-free service
- Users are responsible for their own data security practices
9. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid by you
10. Termination
We may suspend or terminate access if:
- You violate these terms
- Your usage is deemed harmful or unlawful
11. Governing Law
These terms shall be governed by the laws of India, with jurisdiction in Chennai, Tamil Nadu.
12. Changes to Terms
We may update these Terms from time to time. Continued use constitutes acceptance.
13. Refund & Return Policy
Due to the nature of digital software products, the following policy applies:
- All purchases of SreeViewer licenses (subscription or perpetual) are non-refundable, except where required by applicable law.
- Refunds may be considered only if:
- The software fails to function as described, and
- Our support team is unable to resolve the issue within a reasonable time
- Refund requests must be submitted within 7 days of purchase to:

- Change of mind
- Incorrect purchase decisions
- Partial usage of subscription period
14. Force Majeure
We shall not be held liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to:
- Natural disasters (floods, earthquakes, etc.)
- War, terrorism, civil unrest
- Government restrictions or regulatory changes
- Power failures or internet outages
- Cyberattacks or infrastructure failures
During such events, services may be temporarily suspended without liability.
15. Strictly Legal Use Only
SreeViewer is intended strictly for lawful and authorized use.
You agree that you will NOT use the software for:
- Unauthorized remote access or surveillance
- Cybercrime, hacking, or data theft
- Monitoring individuals without consent
- Any activity violating applicable local, national, or international laws
⚠️ Any misuse may result in:
- Immediate suspension of service
- Permanent account termination
- Reporting to law enforcement authorities
16. User Consent Requirement
You must obtain clear and explicit consent before accessing or controlling any remote device using SreeViewer.
Failure to obtain consent may result in legal liability solely borne by the user.
17. Adults Only (Minimum Age Requirement)
SreeViewer is intended for use only by individuals who are 18 years of age or older.
By using the software, you confirm that:
- You are at least 18 years old, OR
- You are using the software under the supervision of a legal guardian or authorized organization
We do not knowingly provide services to minors without proper authorization.
18. Compliance with Laws
Users are solely responsible for ensuring that their use of SreeViewer complies with:
- Data protection laws
- IT and cybersecurity regulations
- Industry-specific compliance requirements
19. Indemnification
You agree to indemnify and hold harmless SreeViewer Private Limited from any claims, damages, or liabilities arising out of:
- Misuse of the software
- Violation of these terms
- Breach of applicable laws
20. Export Control Compliance
You agree not to use or export SreeViewer in violation of any applicable export control laws or regulations.
21. GOVERNMENT (GeM) & PUBLIC SECTOR TERMS
21.1 Compliance with Government Procurement
SreeViewer complies with applicable Government e-Marketplace (GeM) and public procurement policies of India.
- The software is developed and owned by SreeViewer Private Limited
- The product may be classified under “Indian Software / OEM Product” where applicable
21.2 Data Sovereignty (Important for Government Clients)
- All sensitive government data shall be processed in accordance with Indian IT laws and regulations
- Where required, deployment may be restricted to India-based servers or on-premise environments
- No government data shall be transferred outside India
22. INTERNATIONAL LICENSING TERMS
22.1 Territory-Based Licensing
- Licenses may be granted on a country-specific or regional basis
- Resale, distribution, or sublicensing outside the agreed territory is prohibited without written consent
22.2 Compliance with International Laws
Users and partners must comply with:
- Local data protection laws (e.g., GDPR in the European Union)
- Cybersecurity and encryption regulations
- Export control laws
22.3 Data Protection
For customers in regions governed by General Data Protection Regulation (GDPR):
- SreeViewer acts as a Data Processor where applicable
- Customers act as Data Controllers
- Data processing will be performed only as per customer instructions
- Appropriate safeguards (encryption, access control) will be implemented

22.4 Currency & Payment Terms
- Payments may be accepted in INR / USD / other agreed currencies
- Taxes, duties, and foreign transaction charges shall be borne by the customer
22.5 Limitation on High-Risk Jurisdictions
SreeViewer may restrict usage in countries subject to:
- International sanctions
- Export restrictions
- High cybersecurity risk classifications
23. ENTERPRISE & CORPORATE LICENSING TERMS
23.1 Volume Licensing & Deployment
Enterprise customers may be offered:
- Multi-user / concurrent licensing
- On-premise or private cloud deployment
- API-based integrations
23.2 Service Level Agreement (SLA)
For enterprise customers, the following may apply (based on contract):
- Uptime commitment (e.g., 99% or higher)
- Priority technical support
- Defined response and resolution timelines
23.3 Support & Maintenance
- Updates and patches will be provided during active license/subscription
- Enterprise clients may receive dedicated support channels
23.4 Customization & Integration
- Custom features, integrations, or white-label solutions may be provided under separate agreement
- All custom developments remain intellectual property of the Company unless otherwise agreed
23.5 Confidentiality
Both parties agree to protect confidential information, including:
- Technical architecture
- Business data
- Client information
23.6 Data Ownership
- All customer data remains the exclusive property of the customer
- SreeViewer acts only as a service provider
23.7 Deployment Responsibility
Enterprise clients are responsible for:
- Proper internal usage policies
- Employee access control
- Compliance with internal IT and security guidelines
24. CYBERSECURITY & ENTERPRISE SAFEGUARDS
- End-to-end encryption (where applicable)
- Role-based access control
- Session logging and monitoring
- Optional audit logs for enterprise clients
25. DISPUTE RESOLUTION
- Disputes shall first be resolved through mutual discussion
- If unresolved, disputes shall be subject to:
- Arbitration under the Arbitration and Conciliation Act, 1996 (India)
